Dwight <br /> 2630 Edgewood Avenue S. <br /> St.Louis Park,MN 55426 <br /> Re: Ordinance Violation <br /> PIN: 291240040160009 <br /> City of Pequot Lakes <br /> Dear Ms. Dwight, <br /> This letter is to follow up from this weeks meeting with the Technical Evaluation Panel meeting at the <br /> USDA Service Center office regarding your wetland application. As you are aware, the panel has tabled <br /> the application in order to study and better decide what sort of efforts need to be made to improve the <br /> quality of the wetlands on your property. The panel determined that the proper sequencing had been <br /> followed for the property,but wants to ensure that the third step of sequencing—wetlands replacement— <br /> is completed appropriately. <br /> As we discussed, the Technical Evaluation Panel will make a recommendation to the City of Pequot <br /> Lakes about your application, and the City then has final review of your application. Section 7.13 <br /> Subdivision 3 of the Land Use and Subdivision Ordinance states: "Grading or filing in any protected <br /> wetland is prohibited unless authorized by Federal, State, County,and Local permitting agencies." <br /> Since the location of your project is outside of the lake setback,the City does not require any additional <br /> permit, unless the total amount of fill exceeds 100 cubic yards. Fill of 100 cubic yards or more outside of <br /> the lake setback requires a conditional use permit. If you find that your project will require 100 or more <br /> yards of fill,please stop by City Hall or contact us to get more information about that permitting process. <br /> The application deadline for the November Planning Commission agenda is October 19,2005. <br /> In addition, we recently noticed a shed placed on your property.
