STAFF REPORT <br /> `-' Application: Final Plat of Wilderness Point <br /> Applicant: Tom Steffans <br /> Background Information: Wilderness Point Resort is located along the northern <br /> shore of Middle Cullen Lake. The property is zoned Shoreline Commercial. The <br /> proposed subdivision would create 45 privately-owned resort units, which were created <br /> through the Planned Unit Development process. A conditional use permit creating the <br /> Planned Unit Development, along with a preliminary plat, were approved by the City <br /> Council in April of this year,with conditions on each approval.This final plat application <br /> is the final step in the subdivision process. <br /> Applicable Statutes: To obtain final plat approval, an applicant must fulfill the final <br /> plat requirements contained in the Ordinance and must also meet any conditions <br /> imposed by the City during the preliminary plat approval.The preliminary plat for Island <br /> Vista was approved with the following conditions: <br /> i. The road plan shall be reviewed by the City Engineer and emergency response <br /> personal to ensure that emergency responders can service the property. <br /> 2. The bylaws,CIC documents,and any other required legal documents of the <br /> subdivision shall be reviewed by the City Attorney. <br /> The conditional use permit approval also contained some conditions that related to the <br /> final plat application. Specifically: <br /> i. Prior to submission of a final plat application,the following shall occur: <br /> a. The applicant shall submit a stormwater management/erosion control <br /> plan that handles the ioo-year,24-hour storm event in perpetuity. <br /> b. The stormwater management/erosion control plan shall be reviewed by <br /> the Planning Commission. The plan will be revised as directed by the <br /> Planning Commission. <br /> c. Following review and revision as directed by the Planning Commission, <br /> the stormwater management/erosion control plan shall be accepted by <br /> the Planning Commission and then become a controlling document for <br /> the development. <br /> 3. Prior to submission of a final plat application,the following shall occur: <br /> a. The applicant shall submit the rental contract and association contracts to <br /> the City Attorney for review and approval. The documents shall address <br /> the following,at a minimum: <br /> L Mechanism for maintenance of common areas. <br /> ii. Mechanism for maintenance of open space areas. <br /> iii. Mechanism for maintenance of shore impact zone preservation <br /> areas and bluff zones. <br /> iv. The continued operation of Wilderness Resort as a commercial <br /> resort. <br /> b. Revisions shall be made to the documents to the satisfaction of the City <br /> Attorney. <br /> c. Once acceptable to the City Attorney,the documents shall be reviewed by <br /> the Planning Commission. Revisions shall be made to address Planning <br /> Commission concerns. <br />
