11/03/05 <br /> To whom it may concern: <br /> As a resident of the City of Pequot Lakes, and a concerned citizen of the environment, I am writing this <br /> letter to address the proposed sale of 38.4 acres of Potlatch land to Natural Resources Management <br /> (Anderson Brothers)for the use of gravel extraction, crushing,washing, asphalt plant,and concrete plant <br /> in the City of Pequot Lakes. <br /> Furthermore, I am also writing to address my concerns about the application for Conditional Use Permit <br /> (CUP)by Anderson Brother to use Parcel ID No. 290274300000009 for the items outlined above. <br /> I feel the application should be denied for the following reasons: <br /> Lack of full disclosure through application process <br /> 1. Natural Resource Management LLC is not the current Title Holder of the property and the sale <br /> appears to be dependent upon the approval of the CUP. Neither were disclosed on the <br /> application. <br /> Noncompliance with current Planning and Zoning Ordinances <br /> 1. Outlined in section 8.5 Extraction Uses and Restoration of Pequot Lakes Zoning Ordinance it <br /> stated in 2D that Power drives or power producing machinery shall not be house or operated <br /> within 1000 ft of a residential district. The proposed CUP shows rock crushing,asphalt,and <br /> concrete operation within 1000 ft of residential districts. <br /> 2. Outlined in section 8.5 Extraction Uses and Restoration of Pequot Lakes Zoning Ordinance it <br /> stated in 2E that"Accessory processing shall not be in conflict with the use regulations of the <br /> district in which the operation is located. The property is zoned forest management and does not <br /> outline the activity of rock crushing and washing as permitted activities. <br /> 3. Asphalt Plants,Concrete Plants,and Aggregate sales are not outlined as potential use options <br /> under 8.5 Extraction Uses and Restoration or 5.4 Forest Management(FM)of Pequot Lakes <br /> Zoning Ordinance. <br /> 4. The use of Asphalt Plants,Concrete Plants, Aggregate sales,Rock crushing and washing may <br /> cause a violation of standards outlined in section 5.4 Forest Management 4B"Best Management <br /> Practices in Minnesota for Water Quality in Forest Management" <br /> 5. There is not an approved written management plan by a professional forester approved by the <br /> City of Pequot Lakes for the removal of trees for this CUP as required by 5.4 Forest Management <br /> (FM)of Pequot Lakes Zoning Ordinance. <br /> 6. Hours of Operation and Life of operation were not identified as required under 8.5 Extraction <br /> Uses and Restoration of Pequot Lakes Zoning Ordinance paragraph 4H. <br /> 7. The use of Asphalt Plants,Concrete Plants, Aggregate mining,Rock crushing and washing <br /> adjacent to wetlands my be in violation of state or county wetland protection laws. <br />
