2. Does the Final Plat agree with the Preliminary Plat? <br /> �.. 3. Does the City Attorney agree that all parties with an interest in the property are shown as <br /> signers of the document? <br /> 4. Does the City Engineer agree that all improvements required are satisfactorily completed <br /> or are guaranteed by contract with adequate financial security? <br /> 5. Does an independent Professional Land Surveyor agree that the final document meets <br /> the statutory requirements? <br /> 6. Has financial security been posted in the appropriate amount? <br /> Staff Findings: The Staff provides the following findings for the Planning Commission's <br /> consideration: <br /> 1. The additional 33 feet of right-of-way needed for the extension of North Sluetter Road <br /> has been acquired from the State of Minnesota. <br /> 2. The existing outhouse and the existing cabin have not been removed as required by the <br /> conditions on the preliminary plat. <br /> 3. The applicant, or future property owner, has the ability to retain the existing garage on <br /> Lot 4 provided that a land use permit for a principle structure has been obtained within 6 <br /> months of final plat approval. <br /> 4. All parties with an interest in the property are shown as signers of the document. <br /> 5. The City Engineer has not inspected the extension of North Sluetter Road and the <br /> applicant has not provided financial security to cover the costs of improvements. <br /> 6. The applicant has submitted a plat check in which an independent Professional Land <br /> Surveyor finds that the final plat is in agreement with statutory requirements. <br /> 7. Financial security was not required to be posted for this subdivision. <br /> Planning Commission Direction: The Planning Commission should develop findings to <br /> �.. either approve or deny the final plat. In general,the Commission cannot deny a final plat unless <br /> the applicant will not or cannot meet the final platting requirements or the conditions of the <br /> preliminary plat approval.The Commission cannot impose additional conditions that do not fall <br /> directly within the guidelines of the final plat or relate directly to conditions imposed in the <br /> preliminary plat. <br /> The Commission also has the option to table the final plat to obtain additional information. <br /> Staff Recommendation: Based on the findings of fact presented in this report, the Staff <br /> recommends that this final plat application be approved. It should be noted that the applicant <br /> shall be required to pa a park dedication fee upon completion of the final plat. The Staff <br /> recommends that the following condition be included with approval of the final plat: <br /> 1. Before the final plat can be filed, the applicant must either provide financial security to <br /> cover the cost of road improvements or complete the road improvements to City <br /> standards and acceptable to the City Engineer. <br /> 2. The applicant shall remove the existing cabin and outhouse prior to filing of the final plat <br /> or provide financial security to ensure their removal. <br /> City of Pequot Lakes Staff Report 5-2 <br /> October 20,2005 <br />
