STAFF REPORT <br /> Application: Preliminary Plat of Evergreen Fourth Addition—Continuation <br /> Applicant: Arvig Evergreen LLC <br /> Background Information:The applicant owna a parcel that is 22.03 acres in size.The parcel <br /> lies between Highway 371 to the west and Paul Bunyan Trail to the east. It is located at the south <br /> end of Evergreen Point. The parcel has been rezoned to Rural Residential; however, the <br /> subdivision application is being processed under the old Ordinance because the application was <br /> submitted before the rezoning process started. <br /> The preliminary plat was first reviewed in June 2005. The applicant has recently submitted a <br /> revised preliminary plat for review. The concerns about the original preliminary plat reviewed <br /> in June 2005 were as follows: <br /> 1. The impact on the wetlands from the stormwater runoff and the stormwater <br /> management issues that would occur due to the steep slopes and lay of the land. Lots 5, <br /> 6, 7, 8, and 9 all would drain into the wetland on the center of the subdivision, and the <br /> wetland is contained in part on each of those lots. <br /> 2. The variations in elevation and steep slopes of the proposed public road on the west side <br /> of the plat. <br /> 3. The steep slopes on Lots 1,2,and 6 limit the ability to build. <br /> 4. The lack of identified drainfield locations for sewage treatment on Lot 6. <br /> 5. The radii on the culs-de-sac are smaller than what is required by the Ordinance. <br /> 6. Extension of a roadway to the southerly property line. <br /> The applicant originally proposed to create 13 residential lots ranging from 1.24 to 1.93 acres <br /> and one outlot which would have connected the development to the Paul Bunyan Trail. The <br /> revised preliminary plat proposes four residential lots at 1.24, 1.33, 1.35, and 1.92 acres each. <br /> Outlot A is a small strip of land that connects the development to the Paul Bunyan trail. Outlot <br /> B would include the remaining 14.84 acres on the lot. <br /> Applicable Statutes: The Residential zoning standards are applicable and govern lot <br /> dimensions.The Residential district requires the following: <br /> • Lot Area.....................................................30,000 square feet <br /> • Lot Width.....................................................................125 feet <br /> • Lot Depth.........................................................................None <br /> • Lot Coverage.....................................................................30% <br /> • Front Yard Setback........................................................35 feet <br /> • Side Yard Setback..........................................................10 feet <br /> • Rear Yard Setback........................................................20 feet <br /> • Accessory Structures Setback.......................................10 feet <br /> • Maximum Building Height...........................................35 feet <br /> Section 14o deals with subdivisions. Subpart "B" list the submittal items required for a <br /> preliminary plat including existing features and proposed layout. <br /> Subpart"D"discusses minimum design standards. These include the following(only applicable <br /> standards listed): <br /> 1. The land shall be properly zoned and suitable in its natural state for the intended <br /> purpose with minimal alteration.
