Mr. Hemmerick stated that it will take money to upgrade existing road and there is no <br /> plan from the Township and City. He bought the land with road access. He questioned <br /> how much he is supposed to do. He needs an agreement on his share and the people all <br /> along the road. The Planning Commission stated that this is a Council decision, not the <br /> Planning Commission. <br /> Mr. Becker stated that he owns 750 feet along the road and has paid taxes since 1952. He <br /> stated that there was money in the Sibley Township Road Fund and was planned to be <br /> upgraded prior to the annexation. He feels he has paid his dues. <br /> The Planning Commission stated that if the plat is approved, it has access, maybe not <br /> adequate access. <br /> Ron Schaefer stated that once the plat is approved and lots sold,there is no control when <br /> they are built on. Without Preliminary Plat approval, there can be no development until <br /> the road issue is settled. <br /> Mr. Hemmerick is willing to contribute to road improvements. <br /> A motion was made by Dean Williams, seconded by Roger Varilek, as follows: <br /> Understanding the development being proposed the City needs to make improvements to <br /> North Sluetter Road,the City Council take this opportunity, with the developer being <br /> willing to contribute,to undertake an improvement project along the roadway. All <br /> members voted"aye". Motion carried. <br /> A motion was made by Bill Habein, seconded by Tom Adams,to recommend approval of <br /> this plat, based on the findings of fact: <br /> 1. The land is properly zoned Shoreline Residential as the land is located adjacent to <br /> Sibley Lake and is suitable in its natural state for residential development. <br /> 2. Lot 1 contains a substantial portion of the property area as wetlands, with 43,310 <br /> sq. ft. indicated as wetland. The property also has bluff that runs to the southeast <br /> and steep slopes(greater than 12%) in the western portion of the property, which <br /> limits development to the southwestern potion of the property. <br /> 3. Each lot has sufficient area for the placement of two standard soil sewage <br /> treatment systems. <br /> 4. Lot 3 currently has an outhouse located on the property and Lot 4 has an existing <br /> garage and an existing cabin. These structures are currently accessed by a <br /> driveway that runs from the existing cul-de-sac on North Sluetter Road. <br /> 5. Additional means have not been proposed to access the lake, but stairways or lifts <br /> may be constructed should future property owners wish to have lake access. <br /> 6. The lot areas and dimensions conform to the requirements of the Shoreline <br /> Residential zone for all lots except Lot 2. All lots except for Lot 2 have at least <br /> 20,000 square feet of buildable area, and all have at least 100 feet of shoreline and <br /> at least 33 feet of frontage on a public right-of-way.
