r <br /> City of <br /> Pequot AGENDA ITEM # 6.2.0 <br /> Lakes <br /> REPORT TO <br /> CITY COUNCIL <br /> Report Prepared by: Dawn Bittner <br /> Date: March 7, 2017 <br /> Subject: Ordinance Amendment regarding Wetland Setbacks in <br /> all Zoning Classifications <br /> Report: The City Code contains wetland setback requirements <br /> in all zoning classifications except Shoreline Residential and <br /> Urban Residential. The minimum setback is 50 feet in those <br /> zones, except Light Industrial which is 75 feet. The Wetland <br /> Conservation Act does not contain a structure setback for wetlands. <br /> Our Ordinance may be excessive at 50 and 75 feet. <br /> The Planning Commission is unanimously recommending the <br /> Ordinance be amended requiring 30-foot wetland setbacks in all <br /> zones, based on the following Findings of Fact: <br /> 1. A 30-foot wetland setback preserves the lands transitional <br /> between terrestrial and aquatic systems. <br /> 2. This amendment corrects inaccuracies in the Ordinance. <br /> Council Action Requested: <br /> A. Council motion amending the Ordinance requiring 30-foot <br /> wetland setbacks in all zoning classifications. <br /> B. Council motion allowing Summary Publication. <br />
