CITY OF PEQUOT LAKES, CROW WING COUNTY,MINNESOTA ORDINANCE NO. /55) 7 AN ORDINANCE GRANTING TO NORTHERN STATES POWER COMPANY,A MINNESOTA CORPORATION,A NON-EXCLUSIVE FRANCHISE TO ERECT A GAS DISTRIBUTION SYSTEM. THE CITY COUNCIL OF THE CITY OF PEQUOT LAKES, CROW WING COUNTY, MINNESOTA,DOES ORDAIN: SECTION 1. PURPOSE. it is the purpose of this ordinance to grant to Northern States Power Company ("NSF') a non-exclusive franchise for the installation of a gas distribution system for the purpose of installing, enlarging, operating, repairing and maintaining in the City of Pequot Lakes, Minnesota, the necessary gas pipes, mains and appurtenances for the transmission and distribution of gas to said City and its inhabitants and others and transmitting gas into and through said city, and to use the public ways and public grounds of said City for such purpose. This franchise shall not be construed to grant to NSP authority to own or operate a telephone, cable or any other telecommunication system or utility system within the City. SECTION 2. DEFINITIONS. Subdivision 1. "City" shall mean the City of Pequot Lakes, County of Crow Wing, State of Minnesota. Subdivision 2. "City Utility System" refers to the facilities used for providing any public utility service owned or operated by the City or agency thereof, including sewer and water service. Subdivision 3. "Company" or "NSP" means Northern States Power Company, a Minnesota corporation, its successors and assigns. Subdivision 4. "Commission" shall mean the Minnesota Public Utilities Commission, or its successor agency. Subdivision 5. "Gas" as used herein shall be held to include natural gas, manufactured gas, or other forms of gaseous energy. Subdivision 6. "Minnesota OPS" means the Minnesota Office of Pipeline Safety, or its successor agency. 1
