PEQUOT LAKES PLANNING & ZONING COMMISSION
REGULAR MEETING MARCH 28, 1995
The regular meeting of the Pequot Lakes Planning & Zoning Commission
was called to order by Chairman D. Oien at 6:00 p.m. on March 28, 1995
at the Pequot Lakes city hall . Rat]- call showed D. Oien, C. Robideaux,
.. M. Jurchen, and J . Oraskovich all present . Absent was K. Cummings.
Motion by M. Jurchen and seconded by C. Robideaux to approve the
minutes of the previous meetings with one correction on the regular
meeting minutes. Motion carried unanimously.
Sherry Meyer the District Manager for Northern States Power was present
at the request of the Commission in reference to the Pipeline
Ordinance. Ms. Meyer explained that the main feed line can not be
installed closer than 10' to an existing building without installing a
protective casing. The current feed line is 6" diameter, under 60
pounds of pressure and is located in the TH 371 ROW. She will contact
their main office and request a copy of the regulations for the
Commission. The Zoning Administrator was instructed to contact the
League to get sample ordinances regarding pipeline installation.
Marlow Shaffer was unable to attend the meeting tonight but will be
here for the regular meeting in April .
The Commission reviewed a letter from the DNR regarding the preliminary
plat for the industrial park. No action was taken.
Chairman D. Olen had previously received a zoning ordinance violation
complaint on the Nancy Gutz property (Part of SE 1/4 of SE 1/4 Sec. 10,
Twnshp 136) . The commission had referred the complaint to the Zoning
Officer for a report . However, due to a possible conflict of interest
the Zoning Officer recommended that the council appoint another
individual to do the site inspection on this property.
Ms. Gutz was also in attendance and informed the commission that the DG
Towing property that she owns is being used as a full service gas
station. She has also purchased a parcel of property from United
Building Center, which is directly to the east of Dave Ward's antique
shop.
The actual complaint is in reference to the building that Ms. Gutz has
moved onto this new parcel of property and the expansion of a non-
conforming use. The building is the old Conoco building previously
located on First St . in Block 1 , First Addn. to Cole' s Plat .
After much discussion on this matter, Commission member M. Jurchen
suggested that Ms. Gutz write a proposal for the commission on the
intended use of the new building. The commission could then make a
zoning decision on the property.
Chairman D. Oien requested a zoning report be done on how the property
is presently being used before the commission makes any decisions.
Ms. Gutz could not elaborate on the actual use of the property at this
time because she is dealing with several franchises and has not settled
on one at this time, but she stated it would be a retail operation that
L would employee people and assured them it would be a clean operation
and a benefit to the community.
