AGENDA ITEM #7.2 <br /> REPORT TO <br /> CITY COUNCIL <br /> Date: December 6, 2005 <br /> Subject: Right-of-way <br /> Report: Attorney Paul Sandelin has reviewed the right-of- <br /> way issue at the old city hall. Paul has indicated that cities <br /> can allow encroachments on right-of-way. It is his <br /> recommendation that the City adopt a permitting process to <br /> allow this. <br /> As for Mr. Sutton's property, if the Council wishes to allow <br /> the encroachment onto the City's right-of-way, Mr. Sutton <br /> should be informed that the encroachment will be subject to <br /> any permitting procedures the City puts into place in the <br /> future. <br /> Council Action Requested: Council decision by way of <br /> motion to approve or deny the request to locate the trash <br /> receptacles on the City's right-of-way. <br />
