STAFF REPORT <br /> Item: Fence Discussion <br /> Agenda Item:6(c) <br /> Background: The previous Land Use Ordinance required a permit for fences in all zones,but <br /> the new Ordinance did not require permits for fences in any zones. Our current Land Use and <br /> Subdivision Ordinance was amended October 4, 2005 to add fence in the Downtown Mixed Use <br /> (DMU),Urban Residential (UR)and Commercial(C)zones as permitted uses.Our current Land <br /> Use and Subdivision Ordinance lists fences on the Matrix in the SR zone as "Allowed without a <br /> permit". <br /> In addition,Section 5.8 does not include any Performance Standards for Fences. <br /> In order to better manage the placement of fences and to ensure that performance standards are <br /> being met,the Staff feels that the Ordinance should be amended to require a permit for fences in <br /> the Shoreline Residential (SR) zone. Although performance standards are listed for several <br /> zones, the Staff feels that it is particularly important to ensure that performance standards are <br /> being followed in this zone because of the proximity of people and structures in this zone,as well <br /> as setbacks from the Water Resource zoning classification. <br /> Planning Commission Discussion: <br /> 1. Staff recommends that Performance Standards for Fences be added to Section 5.8. <br /> Section 7.3, Performance Standards, states that height is regulated for each district in <br /> Section V. Those heights are: <br /> Rural Residential: 6o inches <br /> Transition Residential: 6o inches <br /> Urban Residential: 6o inches <br /> Commercial: 84 inches <br /> Shoreline Commercial: 6o inches <br /> Downtown Mixed Use: 72 inches <br /> Light Industrial: 84 inches <br /> Recreation: 6o inches. <br /> If the Planning Commission wishes to add Performance Standards for Fences to Section <br /> 5.8,please give Staff direction as to maximum height. <br /> Should Fences remain"Allowed without a Permit"in the SR zone or be amended to <br /> require a permit? <br /> 2. There are no Performance Standards for Fences in the Open Space, Forest Management <br /> or Agriculture zoning classifications.
