STAFF REPORT <br /> Application: Ordinance Amendment to Modify Height Limits in the Light Industrial District <br /> Applicant: City of Pequot Lakes <br /> Agenda Item:3(a) <br /> Background: Over the last couple of months, the Planning Commission has reviewed two <br /> applications for variances for structures exceeding the height limit in the Light Industrial zone. <br /> In both instances, the Planning Commission approved the variances as both variances were for <br /> accessory structures that were required by State statute for safe and healthful operation of the <br /> businesses involved. <br /> In the Light Industrial zone, the height limit may be overly restrictive for the types of uses that <br /> would be typically allowed within that zone. The Planning Commission should consider <br /> amending the Ordinance regarding maximum height in the Light Industrial zone. At last <br /> month's meeting, the Planning Commission directed Staff to draft a proposed Ordinance <br /> amendment that addresses the following: <br /> 1. Increase height for structures that are not occupied,such as equipment. <br /> 2. Require some type of limit for equipment structures. <br /> 3. A principle structure must be present on the property. <br /> Proposed Ordinance Amendment: The Staff proposes the following Ordinance <br /> amendments to Section 5.13 of the Land Use Ordinance: <br /> Subdivision 3.Lot,Use,and Density Requirements: <br /> Building height,principal structure—feet,maximum..........................................25 <br /> Building height,accessory equipment structure—feet,maximum.......................3s <br /> Under Subdivision 4 Performance Standards,add Subpart F Accessory Structure Height: <br /> F. Accessory Equipment Structure Height. The maximum height of accessoryquipment <br /> structures, as detailed in Subdivision 3 of this Section, shall only apply to accessory <br /> structures that are supportive to the use in the primary structure, and are necessary to <br /> carry on the operations within the primary structure. Accessory equipment structures <br /> house apparatuses that support the regular functions contained in the primary building, <br /> but shall not include sheds, garages,or other similar accessory buildings used for storage <br /> purposes,nor shall it include any accessory structure which is occupied by office space or <br /> other space for regular employee use outside of repair and maintenance of the <br /> equipment contained therein. <br /> City of Pequot Lakes Staff Report 1-1 <br /> October 18,2007 <br />
