STAFF REPORT
Item: Third Party Plat Checks
Agenda Item:7(a)
Background: In review of a final plat application at the previous month's meeting, it was
discussed how to appropriately interpret the requirement that the applicant submit a plat check.
Specifically, the Section 11.9,Subdivision 6C of the Ordinance reads as follows:
Does an independent Professional Land Surveyor agree the final
document meets the statutory requirements?
Clearly, the use of independent removes the ability of the surveyor responsible for drawing up
the plat to review his own survey. But the use of independent leaves open the question as to
whether a surveyor from another company outside is required to perform the review.
To remove any confusion that may result and to make it clear to the applicant that a survey by a
surveyor from a company outside of the one originally performing survey work for the
subdivision is required, the Staff proposes the following simple Ordinance amendment.
Does an independent, third parry, Professional Land Surveyor
agree that the final document meets the statutory requirements?
While it had been discussed to make the third parry plat check a requirement by policy or
motion for interpretation, the City has accepted plat checks in the past from surveyors that were
not third parties to the subdivision. An ordinance amendment would ensure that this
requirement is clear to all applicants.
City of Pequot Lakes Staff Report 3_1
April 19,2007
