COMMUNITY city of
GROWTH Pequot _
INSTITUTE l Aes-"'-
STAFF REPORT
Application: Ordinance Amendment to Allow a Public Use in the LI Zone
Applicant: Raymond Johnson,Johnson Transportation Technologies
Agenda Item:4(b)
Background Information: The applicant is requesting an ordinance amendment to
allow a bus storage facility (owned and operated by the school district) in the Light
Industrial Zone. While.this is a general ordinance amendment that would apply to all
Light Industrial property, the specific property regarding this request is located at 4555
Engen Road and is located in the Business/Industrial Park.
............
xY
I
14
%
w
Applicable Regulations: Uses are governed in the Land Use Matrix in Section 17-5.15.
That section indicates the following:
2. All uses are considered prohibited unless specifically allowed in this Code, even
if they are not listed specifically under excluded uses.
There are no provisions in the Land Use Matrix for public uses, bus storage facilities or
anything that could be reasonably interpreted as such. Since the proposed use is not
commercial in nature,- it does not qualify for a Conditional Use Permit under the
umbrella provisions of the Code that are used to address unlisted uses.
Pequot Lakes Staff Report 4(b)-1
May 19,2011
