CITY OF PEQUOT LAKES RESOLUTION 14-10 <br /> FINDINGS, CONCLUSIONS AND ORDER <br /> OF PEQUOT LAKES CITY COUNCIL REGARDING ALLEGED <br /> CODE VIOLATIONS AND NUISANCE CONDITIONS AT 3952 COUNTY ROAD 17 <br /> WHEREAS, notice pursuant to Pequot Lakes City Code ("City Code") Section 7-2.6, <br /> notice of the hearing before the City Council ("City Council") of the City of Pequot Lakes <br /> Minnesota("City"), to consider the alleged code violations and nuisance conditions at 3952 <br /> County Road 17, Pequot Lakes, Minnesota(the "Property"), was duly given to Virgil Dahl, <br /> property owner of record of the Property, by personal service on May 21, 2014; and <br /> WHEREAS, pursuant City Code Section 7-2.6, a public hearing was held on June 3, <br /> 2014, before the City Council to consider the alleged code violations and nuisance conditions <br /> present on the Property, and a list of those individuals testifying at the public hearing is attached <br /> hereto as Exhibit A. <br /> NOW, THEREFORE, the Pequot Lakes City Council, based upon the record and <br /> evidence presented at said hearing, makes the following: <br /> FINDINGS <br /> 1. That garbage,junk, vehicles, mobile homes, structures, and other debris, and <br /> excessive numbers of animals have been allowed to accumulate and are currently <br /> present in plain view on the premises of the Property. <br /> 2. That the accumulation of such garbage,junk,vehicles, mobile homes, structures, and <br /> other debris, and excessive numbers of animals on the premises of the Property is in <br /> violation of the following City Code Sections (prohibited conditions in parentheses <br /> following citation): <br /> a. 7-2.1. Public Nuisance Defined. (refuse, debris, materials and items that are in <br /> the open, not properly stored, and visible from the public right-of-way) <br /> b. 7-2.2. Public Nuisance Affecting Health. (refuse, debris, materials and items <br /> that are in the open, not properly stored, and visible from the public right-of- <br /> way) <br /> c. 7-2.4. Public Nuisance Affecting Peace and Safety. (refuse, debris, materials <br /> and items that are in the open, not properly stored, and visible from the public <br /> right-of-way) <br /> d. City Code, Chapter 17—Land Use and Subdivision Regulations: <br /> i. 4.5 (2) Building Standards (requiring all dwelling units to be a <br /> minimum of 20 feet wide and shall be placed on a foundation; <br />
