I <br /> i <br /> COMMUNITY Gly ej <br /> G ROWIM Pequot _ <br /> INSTITUTE Ues- <br /> '� STAFF REPORT <br /> Application: Ordinance Amendment Regarding Subsurface Sewage Treatment <br /> Systems <br /> Applicant: City of Pequot Lakes <br /> Agenda Item:4(b) <br /> Background Information: Minnesota Statute 115.55 required Counties to update <br /> their septic system ordinances by February, 2014 and be in compliance with Minnesota <br /> Rules Chapters 7o8o — 7o83. Municipalities were given one year after the County <br /> adopted the new rules. The City must amend our ordinance to comply by February, <br /> 2015. <br /> Our current Ordinance adopted Crow Wing County's Ordinance by reference. The <br /> MPCA recommended we adopt the County's Ordinance in its entirety, with minor <br /> changes; the City Attorney concurred. The City Attorney also recommended placing this <br /> Ordinance in Chapter 15 of the City Code, rather than the Land Use Ordinance (Chapter <br /> 17),as it doesn't regulate the use of land. <br /> Planning Commission Direction: The Planning Commission can recommend <br /> approval of the ordinance amendment, denial the ordinance amendment, or the request <br /> can be tabled for further review. <br /> Staff Recommendation: Staff recommends the amendment be approved. <br /> Pequot Lakes Staff Report 4(b)-1 <br /> November 20,2014 <br />
