AGENDA ITEM #9.1

REPORT TO CITY COUNCIL

Report Prepared by: Tim Houle

Date: November 10, 2020

Subject: Wildlife Trail Update

Report: As indicated at the October City Council meeting, we have consulted
with the City Attorney on the proper procedure for the City to accept this road.

As suggested by the City Attorney, Widseth has reviewed publicly available
information and confirmed that the Plat has been recorded, and the Plat includes
Right-of-Way (R/W) dedicated to the Public.

Also as suggested by the City Attorney, Widseth is spot checking the field location
of the R/W versus the edge of the road. At the writing of this Memo (Monday,
November 2), that field survey information was still being obtained and processed.
It does appear, though, from preliminary indications, that there is at least one
location where the existing road does cut close to or is slightly off the R/W.

We would suggest that in any such situation where there is not enough room
between the edge of the road and the R/W for drainage or other public purposes,
the property owners be informed that the road needs to be relocated within the
R/W with City observation, or new R/W obtained, before the City accepts the road.

Council Action Requested: Direct Staff to communicate these findings to all the
property owners.

Council consensus on winter maintenance for Wildlife Trail.
