AGENDA ITEM #9.1 <br /> <br /> <br /> <br /> <br />REPORT TO CITY COUNCIL <br /> <br />Report Prepared by: Tim Houle <br /> <br />Date: November 10, 2020 <br /> <br />Subject: Wildlife Trail Update <br /> <br />Report: As indicated at the October City Council meeting, we have consulted <br />with the City Attorney on the proper procedure for the City to accept this road. <br /> <br />As suggested by the City Attorney, Widseth has reviewed publicly available <br />information and confirmed that the Plat has been recorded, and the Plat includes <br />Right-of-Way (R/W) dedicated to the Public. <br /> <br />Also as suggested by the City Attorney, Widseth is spot checking the field location <br />of the R/W versus the edge of the road. At the writing of this Memo (Monday, <br />November 2), that field survey information was still being obtained and processed. <br />It does appear, though, from preliminary indications, that there is at least one <br />location where the existing road does cut close to or is slightly off the R/W. <br /> <br />We would suggest that in any such situation where there is not enough room <br />between the edge of the road and the R/W for drainage or other public purposes, <br />the property owners be informed that the road needs to be relocated within the <br />R/W with City observation, or new R/W obtained, before the City accepts the road. <br /> <br />Council Action Requested: Direct Staff to communicate these findings to all the <br />property owners. <br /> <br />Council consensus on winter maintenance for Wildlife Trail. <br /> <br /> <br />
