A shoreland ordinance is an important land use regulation that helps to protect surface water <br /> quality, near shore habitat and shoreland aesthetics of Minnesota's public waters. The purpose of this <br /> review is to help you develop"near final" language that can be conditionally approved by the DNR in <br /> time for the public hearing. <br /> Ordinance Evaluation <br /> I have reviewed the following sections that you propose to amend in your draft ordinance received on <br /> November 24, 2020 for compliance with state shoreland rules (MR 6120.2500—6120.3900). <br /> • Chapter 17 Section 17-3.2 Definitions (only those applicable to proposed changes) <br /> • Chapter 17 Section 17-4.4 item 6. Existing Water Oriented Structures <br /> • Chapter 17 Section 17-5.1 item 6. E.Water orientated accessory structures <br /> • Chapter 17 Section 17-5.8 item 3. Lot, Use and Density Requirements table <br /> • Chapter 17 Section 17-5.8 item 4.A. Guest Cottages and Guest Quarters <br /> • Chapter 17 Section 17-5.8 item 4. K.Water Oriented Accessory Structure <br /> I recommend reviewing Chapter 17—Land Use(Zoning)and Subdivision Regulations of Pequot Lakes' <br /> City Code for any other changes that may need to be made related to the proposed amendments for <br /> Guest Cottages and Guest Quarters or Water Orientated Accessory Structures. The proposed definitions <br /> for Shore Impact Zones 1 and 2 might require additional changes to other Sections of Chapter 17 that <br /> may currently reference the shore impact zone. <br /> Attached is the proposed ordinance amendments with DNR comments,color-coded (highlighted text)as <br /> follows: <br /> These comments explain why certain provisions do not meet the minimum <br /> standards in rule and must be changed to receive DNR approval. Please modify these provisions <br /> as requested into the near-final draft you submit for conditional approval. <br />
