CITY OF PEQUOT LAKES RESOLUTION 17-30 <br /> � <br /> FINDINGS, CONCLUSIONS AND ORDER � <br /> OF PEQUOT LAKES CITY COUNCIL REGARDING ALLEGED <br /> CODE VIOLATIONS AND NUISANCE CONDITIONS AT 31116 ASH STREET <br /> '� <br /> WHEREAS,pursuant to Pequot Lakes City Code ("City Code") Section 7-2.6,notice of <br /> the hearing before the City Council ("City Council") of the City of Pequot Lakes Minnesota. <br /> ("City"),to consider the alleged code violations and nuisance conditions at 31116 Ash Street, <br /> Pequot Lakes, Minnesota(the"Property"),was duly given to John R. and Barbara J. Derksen, <br /> property ovcmers of record of the Property, by personal service on August 4,2017; and <br /> WHEREAS, pursuant City Code Section 7-2.6, a public hearing was held on September <br /> 5, 2017, before the City Council to consider the alleged code violations and nuisance conditions <br /> present on the Property, and a list of those individuals testifying at the public hearing is attached <br /> hereto as E�ibit A. <br /> NOW,THEREFORE,the Pequot Lakes City Council,based upon the record and <br /> evidence presented at said hearing, makes the following: <br /> FINDINGS <br /> 1. That John R. and Barbara J. Derksen are the owners of record of the Property, <br /> � <br /> according to Crow Wing County's records as attached hereto as Exhibit B. <br /> 2. That the Property is located in the City's Urban Residential zoning district. <br /> 3. That the property owners of record received written notice of the alleged code <br /> violations and nuisance conditions and of the September 5,2017 public hearing <br /> thereon, as shown in the conespondence attached hereto as E�iibit C. <br /> 4. That miscellaneous junk, construction materials,brush/branches, equipment, and <br /> other debris have been allowed to accumulate and are currently present in plain view <br /> on the premises of the Property. <br /> 5. That the accumulation of such miscellaneous junk, construction materials, <br /> brush/branches, equipment, and other debris on the premises of the Property is in <br /> violation of the following City Code Sections (prohibited conditions in parentheses <br /> following cita.tion): <br /> a. 7-2.1. Public Nuisance Defined. (refuse, debris,materials and items that are in <br /> the open,not properly stored, and visible from the public right-of-way) <br /> b. 7-2.2.
