CITY OF PEQUOT LAKES ORDINANCE NO. 162 AN ORDINANCE REPEALING ORDINANCE NO. 158 AND REGULATING SNOWMOBILES AND RECREATIONAL MOTOR VEHICLES WITHIN THE CITY OF PEQUOT LAKES, MINNESOTA, PLACING RESTRICTIONS ON THE USE AND OPERATION OF SNOWMOBILES AND RECREATIONAL MOTOR VEHICLES WITHIN THE CITY OF PEQUOT LAKES AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF THE CITY COUNCIL OF THE CITY OF PEQUOT LAKES DOES HEREBY ORDAIN AS FOLLOWS: Section 1 . Purpose and Intent. The purpose and intent of this Ordinance is to provide reasonable regulations for the use of snowmobiles and recreational motor vehicles on public and private property in the City of Pequot Lakes . This Ordinance is not intended to allow what the Minnesota Statutes prohibit nor to prohibit what the Minnesota Statutes expressly allow. It is intended to ensure the public safety and prevent a public nuisance . Section 2. Definitions. Subdivision 1 . "Recreational motor vehicle" shall mean any self-propelled vehicle and any vehicle propelled or drawn by a self-propelled vehicle used for recreational purposes, including but not limited to trail bikes or other all-terrain vehicles , motorized go-carts, Hovercraft, motorized bicycle , snowmobile, or motor vehicle licensed for highway operation which is being used for off-road recreational purposes . Subdivision 2 . "Snowmobile" shall mean a self-propelled vehicle designed for travel on snow or ice or natural terrain steered by wheels, skis , runners or power-driven drum or tracks . Subdivision 3 . "Motorized bicycle" , shall mean a bicycle with fully operable pedals which may be propelled by human power or a motor , or by both, with a motor of a capacity of less than 50 cubic centimeters piston displacement, and a maximum of two break horsepower, which is capable of a maximum speed of not more than 30 miles per hour on a flat surface with nor more than one percent grade in any direction when the motor is engaged. Subdivision 4 . "All-Terrain Vehicle" or "ATV" , shall mean trail bikes, amphibious vehicles and similar devices, other than snowmobiles, used at least partially for travel on natural terrain, but not "special mobile equipment" as defined in M. S. 168. 011 , Subdivision 22 , which is hereby incorporated herein by reference . Subdivision 5 . "Operate" means to control the operation of a snowmobile, motorized bicycle, all-terrain vehicle or recreational motor vehicle . Subdivision 6 . "Operator" means a person who operates or is in control of a snowmobile, motorized bicycle , all- terrain vehicle or recreational motor vehicle . Subdivision 7 . "Snowmobile Trail" means the property designated for use by snowmobiles in the City of Pequot PAGE 1
