Page 1 of 2 <br /> CITY OF PEQUOT LAKES <br /> ORDINANCE #196 <br /> AN ORDINANCE ESTABLISHING RURAL AND URBAN TAXING DISTRICTS <br /> WHEREAS, the City of Pequot Lakes and the Township of Sibley have requested that the <br /> Minnesota Planning Board order annexation of the entire Township into the City; and <br /> WHEREAS, it is the desire of the City Council and the Board of Township Supervisors to <br /> maintain the rural character of the Township properties; and <br /> WHEREAS, the City Comprehensive Plan and Zoning Ordinance both provide for <br /> maintenance of that rural character, <br /> NOW THEREFORE BE IT ORDAINED: <br /> The Rural Service/Taxing District shall include all lands formerly including in the boundaries of <br /> the Township of Sibley based on the following: <br /> 1. In the judgment of the Pequot Lakes City Council, these lands are rural in character. <br /> 2. There are no properties that are developed for commercial, industrial or urban <br /> residential purposes. <br /> 3. The properties within the Rural Service/Taxing District would not benefit from municipal <br /> services financed by general taxation to the same degree as other lands. <br /> The Urban Service/Taxing District shall include all lands within the boundaries of the city which <br /> are not included in the rural service/taxing district. <br /> The approximate ratio, which in the judgment of the Pequot Lakes City Council, exists between <br /> the benefits resulting from tax supported municipal service to parcels of land of like market <br /> value situated in the rural service district and in the urban service district respectively is 1:1.3. <br /> Whenever any parcel of land, owned by one person or by two or more persons jointly or in <br /> common at the time of its inclusion in the rural service district is platted, in whole or in part, and <br /> whenever application is made for a permit for the construction of a commercial, industrial or <br /> urban residential development or improvement to be situated on such parcel or any part <br /> thereof, the Zoning Commission approving such plat or building permit shall report this to the <br /> governing body, which shall make and enter an order transferring such parcel from the rural <br /> service district to the urban service district. <br /> Adopted this day of , 2002. <br /> Forbes H.
