STAFF REPORT
Item: Hemmerich Subdivision
Earl and Jeannine Hemmerich own a property located on the western shore of Sibley Lake on
North Sluetter Road. The Hemmerch's would like to subdivide their property but need to have
frontage on a public right-of-way for those lots. The Hemmerich's have proposed extending
North Sluetter Road north in order to meet this requirement. However,North Sluetter Road runs
along the border between Pequot Lakes and Loon Lake Township, putting half of the right-of-
way in the City and the other half in the Township.
The property immediately to the west of the Hemmerich property is State of Minnesota Trust
Fund land managed by the Minnesota Department of Natural Resources. The Department of
Natural Resources may grant permanent or temporary easements across State-managed land for
the road, but because this is Trust Fund land, the easement can only be granted to a governmental
unit and not an individual.
Mr. Hemmerich is requesting that the City be named as the applicant to acquire the easement.
Mr. Hemmerich will agree to pay the fees associated with the Application, and if the application
is approved, the Hemmerich's will be responsible for the construction of the roadway.
June Staff Report 10-1
