STAFF REPORT <br /> Application: Preliminary Plat of Evergreen Fourth Addition <br /> Applicants: Arvig Evergreen LLC <br /> Background Information: The applicants own a parcel that is 22.03 acres in size. The parcel <br /> lies between Highway 371 to the west and Paul Bunyan Trail to the east. It is located at the south <br /> end of Evergreen Point. The parcel is zoned Residential and is abuts property zoned Forestry to <br /> the south, Agricultural to the east,and Residential to the north. The applicant proposes to create <br /> 13 Residential lots ranging from 1.24 to 1.93 acres and one outlot which will connect the <br /> development to Paul Bunyan Trail. <br /> Applicable Statutes: The Residential zoning standards are applicable and govern lot <br /> dimensions. The Residential district requires the following: <br /> • Lot Area 30,000 square feet <br /> • Lot Width 125 feet <br /> • Lot Depth None <br /> • Lot Coverage 30% <br /> • Front Yard Setback 35 feet <br /> • Side Yard Setback 10 feet <br /> • Rear Yard Setback 20 feet <br /> • Accessory Structures Setback 10 feet <br /> • Maximum Building Height 35 feet <br /> Section 140 deals with subdivisions. Subpart`B"list the submittal items required for a <br /> preliminary plat including existing features and proposed layout. <br /> Subpart"D"discusses minimum design standards. These include the following (only applicable <br /> standards listed): <br /> 1. The land shall be properly zoned and suitable in its natural state for the intended purpose <br /> with minimal alteration. Land subject to flooding, land below the ordinary high water <br /> mark, wetlands, areas with high water table, bluffs or land containing other significant <br /> constraint(s) upon future intended usage, shall not be considered in the minimum size of <br /> the lot. The suitability analysis for each lot shall also consider soil and rock formations <br /> with severe limitations for development, severe erosion potential, steep topography, <br /> inadequate water supply or sewage treatment capabilities, nearshore aquatic conditions <br /> unsuitable for water-based recreation, important fish and wildlife habitat, presence of <br /> significant historic sites, or any other feature of the natural land likely to be harmful to <br /> the health, safety, or welfare of future residents of the proposed subdivision or of the <br /> community. <br /> 2. Each lot shall have a minimum contiguous lawn area that is free of limiting factors <br /> sufficient for the construction of two standard soil treatment sewage systems. New lots <br /> requiring mound systems or holding tanks shall not be allowed. <br /> 3. Lot areas and dimensions shall conform to the requirements of the Zoning Ordinance, <br /> without a variance. <br /> 4. Lot layouts shall be compatible with the existing layout of adjoining properties. <br /> June Staff Report 4-1 <br />
