STAFF REPORT <br /> Application: Preliminary Plat for a planned unit development in the Waterfront <br /> Commercial zone. <br /> Applicant: Wilderness Point Resort, LLC <br /> Background: Wilderness Point Resort is proposing to build a rent-back resort, on the <br /> northern shore of Middle Cullen Lake in the Waterfront Commercial Zoning District. <br /> The application is in three parts. This report reviews the preliminary plat application. <br /> The other staff reports review the conditional use permit for a planned unit development <br /> and a rezoning application. This application is contingent upon approval of the <br /> accompanying conditional use permit for a planned unit development and the rezoning <br /> application. This application creates the subdivision designed in the planned unit <br /> development. <br /> A planned unit development(PUD) must meet all setback requirements of the underlying <br /> zone; however, a PUD is more flexible in where structures are allowed and the <br /> concentration of structures. The preliminary plat proposes to create 54 units on 32.3 <br /> acres. The resort crosses four tiers of development. The first tier will have 34 units, the <br /> second tier will have 17 units, and the third tier will have three units. The forth tier will <br /> not have any units. Each lot size will be approximately the same size as the unit built <br /> above it. <br /> Applicable Statutes: Ordinances applicable to this application are listed below, drawn <br /> directly from the Pequot Lakes Land Use Ordinance. <br /> Section 130.020: Dedication to the Public—Standards <br /> The developer of a subdivision and/or Planned Unit Development shall dedicate ten <br /> percent (10%) of his usable land to the public for park purposes, or at the option of the <br /> City Council, shall pay the City an amount equal to ten percent(10%) of the current <br /> estimated market value of the land prior to development with a minimum fee of$500 and <br /> a maximum fee of$5,000 per lot or unit. For the purposes of this Section, " <br /> estimated market value" is defined by the Crow Wing County Assessor, as of the date the <br /> subdivision/planned unit development is granted final approval by the City Council. <br /> Please refer to Section 130.020 in the Land Use Ordinance for full park dedication <br /> regulations. Park dedication fees are not due until the final plat is filed. <br /> Section 140.020: Standards <br /> A. Preliminary Plat. A Preliminary Plat shall contain the following data: (except as <br /> waived by the Planning & Zoning Commission)along with other reasonable <br /> information required by the Planning and Zoning Commission needed to make a <br /> property evaluation of the proposal. <br /> February Staff Report Page 20 <br />
