ARTICLE VHI. <br /> ARCHITECTURAL AND EXTERIOR CONTROLS <br /> Section 1. No building, driveway, walkway, wall, fence, garage, aerial, antenna, wire, pipe, <br /> dock, mailbox, mailbox stand, exterior ornament, swimming pool, landscaping, swing set, play area, <br /> dock or other structure or foliage (hereafter "Improvement") shall be constructed, altered, improved <br /> or placed upon a Lot without written approval by the Architectural Control Committee of the plans <br /> and specifications of said Improvement, including site location thereof and of the builder who will <br /> actually perform the proposed work, in accordance herewith: <br /> (a) The Architectural Control Committee shall consist of three (3) individuals to be <br /> appointed or elected by the Owners of the Lots. Subject to Article, I11, Section 2, each Lot Owner <br /> shall be entitled to one vote for each Lot owned, regardless of 'many Lots may be owned by a <br /> single, common, or Joint Owner(s). Fee Owners of record, as to lected in the office of the County <br /> Recorder for the County in which the Lots are located, shall c nclt ely be deemed the "Owner" of <br /> a particular Lot for purposes of voting for Architectu� ontrol ittee Members; provided, <br /> however, any person in possession of said Lot under >icorded contract deed from the recorded <br /> fee Owner will be deemed the "Owner" in lieu of 46 record fee Owner of such Lot. Election of <br /> Architectural Control Committee Members shall be condtwted at a meeting of said Lot Owners <br /> pursuant to notice mailed first class to the mess to wbiCh real property tax statements are sent to <br /> each such Lot Owner (if an Owner owns mcWil0a one L(i only one notice need be given to such <br /> Owner). Proof of mailing, whether by affidavit or certificate from the post office or by return receipt <br /> certificate from the post office or by fern request shall be conclusive evidence of notice <br /> t <br /> `. being given to any particular Lot neid Marty[ shall be held as determined by the Architectural <br /> Control Committee except that once fifty percent( %)or more of the Lots have been improved with <br /> Units, said meetings shall take pie�,; Subdivision. Owners representing <br /> at least 25% of the Lots fil'bil an Emit "A" shall be necessary to constitute a quorum of such Lot <br /> Owners for a meeting to elect, remove, or re-election or replacement of Architectural Control <br /> Committee Members. Architectural Control Committee Members shall serve without compensation <br /> until replaced or remove by the next meeting of Lot Owners or until they resign. <br /> (b) The Archittontrol Committee shall govern itself according to a majority vote <br /> of the Committee Members. The Architectural Control Committee, within thirty (30) days of its <br /> election, or change in its membership pursuant to a Lot Owner's meeting (or in the event no such <br /> change in membership has occurred during a given calendar year subsequent to the calendar year <br /> 2004, then, prior to February 1 of each such subsequent year) shall notify each Lot Owner (in the <br /> same manner required for Lot Owner Meetings) of the name and address of each Architectural <br /> Control Committee Member, together with a copy of subparagraphs (a), (b), (c), and (d) of this <br /> Section 1, Article VIII. <br /> (c) From and after the completion of a Unit on a particular Lot, no building, fence, wall, <br /> or other Improvement shall be commenced, erected or maintained upon any such Lot, nor shall any <br /> exterior addition to or change or alteration therein be made, nor shall any improvement be placed, <br /> planted or constructed within such Lot until the plans and specifications showing the nature, kind, <br /> shape, height, materials and location of the same shall have been submitted to and approved in <br /> 17 <br />
