MEMORANDUM <br /> TO: MAYOR AND CITY COUNCIL <br /> FROM: SANDY PEINE <br /> DATE: DECEMBER 7, 2004 <br /> SUBJECT: PUBLIC ROAD EASEMENT TO SIBLEY LAKE <br /> Greg Karr has requested the City to sell him a ten foot public road easement <br /> that extends from West Lake Street to Sibley Lake. The 10 foot easement is <br /> platted as a street and is dedicated on the plat of Pequot Shady Shores as <br /> "public use forever." See attached plat language. <br /> Since Mr. Karr's request, I have received comments from other surrounding <br /> neighbors indicating their concern with vacating the easement. Attached is a <br /> letter from Mr. and Mrs. Gordon Buyse and notes from a telephone <br /> conversation with Lee Moren. They have also indicated that Dona good is <br /> not in favor of the vacation. <br /> The Council can vacate a road after holding a public hearing. If this is what <br /> the Council chooses to do, then a decision would have to be made as to how <br /> to dispose of the easement. <br /> Staff Recommendation <br /> After reviewing the issue, it would be staff's recommendation to leave the <br /> 10' road easement as dedicated to the public as stated in the plat. <br />
