3. Lot 1 and Lot 2,although they have steep topography, would be able to be <br /> developed for residential use without major topographic alteration. A dwelling <br /> could be placed on the ridge of Lot 1 with an access drive placed at a reasonable <br /> grade. Lot 2 is already developed with a home and three accessory structures. <br /> 4. Lot 3 and Lot 4 are marginally buildable due to steep topography. There is room <br /> for dwellings on the property. Access to the dwelling sites is improved through <br /> the installation of a cul-de-sac. <br /> 5. Soils are indicated to be very suitable for onsite sewage treatment. <br /> 6. There is adequate room on Lots 1, 2 and 4 for construction of two standard <br /> individual sewage treatment systems. <br /> 7. It is unclear if Lot 3 has adequate area for the construction of two standard <br /> individual sewage treatment systems. The area that is high and buildable on the <br /> lot will be needed for the dwelling and access drive. The remaining land is on a <br /> steep slope that will be inundated with stormwater during rain events. <br /> 8. Lots 1 and 2 abut North Oak Street, a publicly maintained street, and are <br /> accessible off of the minimum of 33-feet of public right-of-way. <br /> 9. Lot 3 and 4 are proposed to access off of public right-of-way to be dedicated for a <br /> cul-de-sac. <br /> The Commission further recommends that the following conditions be included in a <br /> motion to approve: <br /> 1. A deed restriction appears that the pole building will be removed when Oak Street <br /> is improved. <br /> 2. The gap be taken care of before moving to Final Plat and not at the City's <br /> expense. <br /> 3. Rezone the parcel to residential prior to Final Plat application. <br /> 3. Shoreline alteration violation, after-the-fact permit fine: In June Staff had <br /> received a complaint regarding substantial shoreline alteration being done. The <br /> property owner met with the Planning Commission and agreed to a reconstruction <br /> plan. The fee for a shoreline alteration permit is$150.00. The after-the-fast <br /> permit fee is five times the original fee. <br /> The Planning Commission is unanimously recommending that the property owner be <br /> assessed the five times after-the-fact fine for this violation($150.00 X 5= $750.00), <br /> and recommend the after-the-fact portion of the fine ($600.00) be designated to a lake <br /> education program. <br /> The Planning Commission has set up a schedule for review of the draft ordinance, which <br /> they are forwarding to you with this report. They would like to go through each section <br /> in a thorough and meaningful way and would like your input in the process. The <br /> Commission has asked staff to extend you a formal invitation to attend these working <br /> sessions, to offer your comments and suggestions and to get involved in this important <br /> review process.
