MPCA PROPERTY ACCESS AGREEMENT <br />WITH <br />Citv of Peauot Lakes <br />(Property Owner) <br />1. Purpose of Agreement. As part of its duties under state law, the Minnesota Pollution <br />Control Agency (MPCA) maintains a network of groundwater monitoring wells to monitor <br />the quality of the groundwater in Minnesota. Information on the groundwater monitoring <br />network is available at http://www.pca.state.mn.us/index.php/water/water-types-and- <br />programs/groundwater/groundwater-monitoring-and-assessment/index.html. The MPCA is <br />seeking to install additional wells to add to its netwark in Crow Wing County. The City of <br />Pequot Lakes owns property in the targeted area that the MPCA has determined would be <br />suitable for the installation of groundwater monitoring wells that would be part of the <br />MPCA's groundwater monitoring network. <br />2. Parties. This agreement is between the MPCA and the City of Pequot Lakes (the <br />"Property Owner") where the MPCA would like to install monitoring wells. <br />3. Authority. The MPCA is authorized to enter any property, public and private, for the <br />purpose of conducting surveys under Minn. Stat. § 115.04, subd. 3. The Property Owner has <br />the duty to cooperate with the MPCA under Minn. Stat. § 115.06. <br />4. Consent to access. The Property Owner hereby authorizes the MPCA, its employees and <br />agents, to enter the Properties shown on attachment 1(maps of well locations) for the <br />purpose of: <br />1) installing a single groundwater monitoring well and/or protective posts at each <br />location shown on attachment 1; and <br />2) collecting groundwater samples from the monitaring wells on an annual basis until <br />this Agreement is terminated. <br />5. Pre-installation meeting. The MPCA or its designated representative will meet with the <br />designated Property Owner's designated contact person at least two weeks before the <br />installation. At this time, the MPCA or its designated representative will provide the Property <br />Owner with the name of the MPCA's contractor, and the Property Owner will provide the <br />MPCA with information concerning any hours or operation restrictions or other policies that <br />might be applicable. The MPCA or its designated representative will ensure that its contactor <br />is aware of and complies with Property Owner ordinances on noise and hours of operation. <br />At the meeting, the MPCA or its designated representative and the Property Owner will <br />identify a specific mutually agreeable location within each designated property on <br />attachment 1 for the monitoring well. <br />6.
