PROSECUTION AGREEMENT <br /> WHEREAS, the City of Pequot Lakes is desirous of having Mallie Law Office P.A. provide <br /> prosecution services for the petty misdemeanor, misdemeanor and applicable gross misdemeanor <br /> offenses arising out of its jurisdiction and, <br /> WHEREAS, Mallie Law Office, P.A. is willing to provide such prosecution services, <br /> NOW, THEREFORE, pursuant to the mutual agreement between the City of Pequot Lakes <br /> and Mallie Law Office, P.A. both parties consent to the following: <br /> I <br /> That said agreement shall be effective commencing on January 1, 2004, and shall continue <br /> through December 31, 2006. <br /> II <br /> Matthew R. Mallie agrees to provide prosecution services pursuant to the following <br /> arrangement: <br /> (1)That the City of Pequot Lakes shall pay a base fee to Mallie Law Office, P.A. of$700.00 <br /> per month. <br /> III <br /> That Mallie Law Office P.A. shall receive compensation for any vehicle forfeitures pursuant to <br /> Minnesota Statute 169A.63, Subdivision 10, (b)(2). In the event this statute subdivision is repealed or <br /> is inapplicable future compensation for legal services related to vehicle forfeitures shall be subject to <br /> negotiation. , <br /> IV <br /> That commencing on January 1, 2007, this agreement shall be renewed with the same terms <br /> and conditions for an additional three years from the date of January 1, 2007, at the election of Mallie <br /> Law Office, P.A. This agreement shall continue every three years thereafter with the consideration of <br /> renewal to occur within the year prior to the third year of the agreements three year term. Said renewal <br /> shall occur automatically unless the City of Pequot Lakes, seeking to discontinue the contract, submits <br /> in writing to Mallie Law Office, on or before the 31 st of December of the year of renewal, that they <br /> wish to discontinue such contract. In the event the City of Pequot Lakes does not renew such <br /> contract, or the contract is not modified, Mallie Law Office will be obligated to complete and fulfill <br /> prosecution services for that year following the year of renewal at which time the underlying contract <br /> shall cease. <br />
