COMMUNITYGROWTH <br /> I N S T I T U T E <br /> December 20, 2005 <br /> Mayor and City Council <br /> City of Pequot Lakes <br /> 4638 County Road 11 <br /> Pequot Lakes, MN 56472 <br /> Re: Special Meeting/Wilderness Point Final Plat <br /> Dear Mayor and City Council: <br /> The topics for a special meeting are limited to those on the agenda, which in this case includes <br /> the final plat for Wilderness Point. The Planning Commission has reviewed this application and <br /> is recommended that it be approved, based on the following findings of fact: <br /> 1. Emergency response personnel with the City have indicated that the proposed layout <br /> would adequately facilitate access for emergency response vehicles. <br /> 2. The City Attorney has indicated that he has received and approved of the Disclosure <br /> Statement, Bylaws, Articles of Incorporation and the Declarations/Covenants. The <br /> Planning Commission has approved these documents. <br /> 3. The applicants have submitted a stormwater management/erosion control plan. The <br /> Planning Commission has approved this plan. <br /> 4. The City Attorney has reviewed the rental contracts. They have been found acceptable to <br /> the City Attorney. The Planning Commission has approved these documents. <br /> 5. The applicants have submitted a sewage treatment design that has been reviewed and <br /> found satisfactory by the City Engineer. The design has been approved by the Planning <br /> Commission. <br /> 6. The applicants have submitted a vegetation enhancement plan. This plan has been <br /> approved by the Planning Commission. <br /> 7. A rezoning to Open Space of the common areas has been applied for concurrently with <br /> the final plat, as required in the Conditional Use Permit. <br /> 8. The final plat agrees with the preliminary plat as approved by the City in April of 2005. <br /> 9. The City has received a title opinion. The title opinion is acceptable to the City Attorney. <br /> 10. The City Attorney has prepared a development agreement to address issues surrounding <br /> financial security. <br /> 11. The City has received a plat check. <br /> The Planning Commission further recommends that the following condition be included in a <br /> motion to approve: <br /> 1.
