COMMUNITYGROWTH
I N S T I T O T E
November 24, 2005
Mayor and City Council
City of Pequot Lakes
4638 County Road 11
Pequot Lakes, MN 56472
Re: Zoning Administrator's Report
Dear Mayor and City Council:
The Planning Commission met for their regularly scheduled November meeting where they held four
public hearings — one for an individual property rezoning, two for final plats, and one for a
conditional use permit. One of the public hearings, two were tabled at the request of the applicants,
one was tabled with a request for more information, and the conditional use permit application was
denied. The decision to deny the conditional use permit, which was for the Anderson Brothers
Gravel Pit,was appealed. It will come in front of you for a hearing at a later date.
The Planning Commission also held discussion on park dedication fees, a road vacation, campground
development options, and the State Building Code. The Planning Commission is forwarding you the
following recommendations for your consideration:
`-' 1. State Building Code, City of Pequot Lakes.
The Planning Commission has had much discussion over about whether the City of Pequot Lakes
should adopt the State Building Code. Adopting the code would require the hiring of a staff,
either full-time or consultant, to act as the City building inspector. The Planning Commission has
not seen an imperative need to adopt the Code and also have not had any response either for or
against the building code from area builders. As such, the Planning Commission is
recommending that the City of Pequot Lakes not adopt the State Building Code. The
Planning Commission would be willing to reconsider adopting the Code if there were vocal
support from area builders.
2. Extractive Use Moratorium, City of Pequot Lakes.
The Planning Commission has recently held public hearings for conditional use permit
applications for extractive uses. One extractive use operation was located in the northeastern part
of the City, while the more recent one was located just to the west of State Highway 371 near
Mayo and West Twin Lakes. The recent application raised concern over whether the Ordinance is
correct in where extractive uses are currently being allowed as conditional uses. The Planning
Commission would like to further study the matter and decide where extractive uses would be
appropriate conditional uses in the City. The Planning Commission is recommending that the
City of Pequot Lakes adopt a moratorium on extractive use applications so that the City
may study and define appropriate locations for such uses.
14084 Baxter Drive, Suite 7
Baxter, MN 56401
(218) 828-3064
www.communitygrowth.com
