City Council Minutes <br /> November 1, 2005 <br /> Page 4 <br /> ---------------------------------- <br /> Chuck Marohn indicated that Earl Hemmerich is requesting a final plat of <br /> Island Vista. He noted that the Planning Commission recommended <br /> approval based on seven findings of fact stated in the Zoning <br /> Administrator's report dated October 24, 2005 and contingent on park <br /> dedication being paid. Mr. Marohn indicated that the applicant is prepared <br /> to pay the park dedication at this time; however, the Park Board still has to <br /> review the issue. <br /> COUNCIL MEMBER NAGEL MOVED TO ACCEPT THE FINAL PLAT <br /> OF ISLAND VISTA BASED ON THE 7 FINDINGS OF FACT STATED BY <br /> THE PLANNING COMMISSION AND THE FOLLOWING CONDITIONS: <br /> 1. BEFORE FINAL PLAT CAN BE FILED, THE APPLICANT MUST <br /> EITHER PROVIDE FINANCIAL SECURITY TO COVER THE COST OF <br /> ROAD IMPROVEMENTS OR COMPLETE THE ROAD IMPROVEMENTS <br /> TO CITY STANDARDS AND ACCEPTABLE TO THE CITY ENGINEER. <br /> 2. PARK DEDICATION BE PAID. <br /> �. COUNCIL MEMBER PFEIFFER SECONDED THE MOTION. MOTION <br /> CARRIED 6-0. <br /> COUNCIL MEMBER RYAN MOVED TO DIRECT THE PLANNING <br /> COMMISSION TO STUDY THE ISSUE OF PARK DEDICATION FEES. <br /> COUNCIL MEMBER NAGEL SECONDED THE MOTION. MOTION <br /> CARRIED 6-0. <br /> 8.3. Rezoning Request for Smith Property <br /> Chuck Marohn stated that the Planning Commission has recommended <br /> denial of the rezoning of the Smith Property from transition residential to <br /> urban residential based on nine findings of fact. <br /> MAYOR MALECHA MOVED TO DENY THE REZONING REQUEST OF <br /> THE SMITH PROPERTY BASED ON THE PLANNING COMMISSION'S <br /> RECOMMENDATION AND FINDINGS OF FACT LISTED IN THE <br /> ZONING ADMINISTRATOR'S REPORT DATED OCTOBER 24, 2005. <br /> COUNCIL MEMBER PFEIFFER SECONDED THE MOTION. MOTION <br /> CARRIED 6-0. <br /> 8.4. Ordinance Amendment for Recreation Zone <br />
