Motion carried. 4—2. <br /> APPLICANT: Carl and Colleen Smith <br /> Applicant requests to rezone from Transition Residential to Urban Residential. Parcel#'s <br /> 290104100A00009 and 290104100BA0009. <br /> Mr. Marohn explained the Staff Report. Applicants were present. Also present was <br /> Mark Forsberg, owner of one of the parcels. His address is Two Harbors, Minnesota. He <br /> stated the he would like it rezoned to Urban Residential. This parcel was part of the old <br /> City, at the very edge next to the old Township. <br /> The property to the north is a full 40 acres or more, presently zoned Agriculture. The <br /> entire parcel wouldn't need to be rezoned, only a portion. A parcel can be more than one <br /> classification. <br /> Finding of Fact #1 quotes the Comprehensive Plan. Urban Residential is suburbia and <br /> does not follow Comp Plan. Urban and rural characteristics were discussed. <br /> Mr. Smith stated that one parcel was Multi-family before the City rezone, up to <br /> Forsberg's. <br /> Topography was also discussed. There is up to 30' relief. Impervious coverage was also <br /> discussed. The parcels now are less than 5% impervious and would be 40% at Urban <br /> Residential. <br /> City water and sewer need to be brought up to zone this Urban Residential. The <br /> Wastewater Superintendent had been contacted and he stated this development takes up <br /> half of the remaining capacity. There is no City stormwater near this area. <br /> A motion was made by Mark Hallan to draw a line from the southwestern corner of <br /> parcel A straight west to the Trail and zone the portion of BA lying south of this line <br /> Urban Residential and zone the portion of BA lying north of this line and A to Transition <br /> Residential. Motion died for lack of a second. <br /> A motion was made by Dean Williams, seconded by Scott Pederson, to recommend <br /> denial of this request based on the following Findings of Fact: <br /> 1. The rezoning to Urban Residential is not consistent with the City's <br /> Comprehensive Plan and Future Land Use Map, which designates this area as <br /> Urban/Rural Transition. <br /> Planning Commission 6 <br /> October 20, 2005 <br />
