City Council Minutes <br /> November 1, 2005 <br /> Page 5 <br /> ---------------------------------- <br /> COUNCIL MEMBER RYAN MOVED TO ADOPT ORDINANCE 05-11 <br /> AMENDING SECTION 5.14 OF THE ZONING ORDINANCE TO <br /> BECOME RECREATION (R) AND REVISING THE TITLE FOR THE <br /> LAND USE MATRIX. COUNCIL MEMBER NAGEL SECONDED THE <br /> MOTION. MOTION CARRIED 6-0. <br /> 13.2. Request for City to Maintain New Section of North Sluetter Road <br /> Mike Loven indicated that Earl Hemmerich has constructed an extension <br /> of North Sluetter Road to serve the new Island Vista plat. Mike Loven <br /> indicated that the improvements were up to City standards with the <br /> exception of the vegetation on the sides of the road. He recommended <br /> that there be a binder placed on the seed to promote vegetative growth. <br /> COUNCIL MEMBER GREER MOVED TO ACCEPT THE NEW <br /> EXTENSION OF NORTH SLUETTER ROAD AS A CITY STREET WITH <br /> THE CONDITION THAT A BINDER BE PLACED ON THE SEED TO <br /> PROMOTE VEGETATIVE GROWTH. COUNCIL MEMBER RYAN <br /> SECONDED THE MOTION. MOTION CARRIED 6-0. <br /> Dumgster in City Right-of-Way <br /> Mr. Marohn indicated that some Council Members have received <br /> complaints regarding a dumpster, concrete pad, and fence that will be <br /> placed on City right-of-way at the old City Hall reconstruction site. Chuck <br /> Marohn indicated that he is proposing to send the owner a letter <br /> acknowledging that they are using the right-of-way and placing stipulations <br /> on the use. The stipulations indicate that the dumpster must be moved if <br /> city roadway improvements are made in the area, or if the owner develops <br /> the adjacent parcel of property. <br /> David Kennedy addressed the Council regarding his concern of <br /> unsightliness from his business and the problems the fence would create <br /> for snow removal. He requested the City to seek legal advice. <br /> COUNCIL MEMBER GREER MOVED THAT THE OWNER CEASE <br /> WORK IN THE RIGHT-OF-WAY UNTIL THE CITY REVIEWS THIS <br /> ISSUE WITH ITS ATTORNEY. COUNCIL MEMBER RYAN SECONDED <br /> THE MOTION. MOTION CARRIED 6-0. <br /> Council Member Ryan suggested that procedures be established so these <br /> types of issues are revealed during the normal review process. <br />
