c. No filling or disturbing wetland(s)areas.
d. Silt fences shall be placed at edge of wetlands during construction.
The Planning Commission further recommends that the following condition be included in
a motion to approve:
1. The applicant shall submit soil borings indicating that the soils are suitable for a primary and
alternate individual sewage treatment system(ISTS, commonly known as septic system).
2. The applicant shall propose a name for the proposed public road.
3. Cul-de-sac construction shall be maintained within the designated right-of-way with no other
areas disturbed outside of the right-of-way,particularly in Outlot B.
2. Rezoning from Agricultural Zone to Agriculture Zone under New Ordinance, PIN
290141200000009,Mary Pfeiffer,City of Pequot Lakes.
The property is located east of downtown on County Road 11 and is roughly 43 acres in size.
The property was previously zoned Agricultural under the old Ordinance, and the proposed
zoning for the property is Agriculture. The owner has indicated to Staff that she would not like
to have the density of the property increased and prefers that the property be zoned Agriculture.
The Planning Commission is recommending that the property,PIN 290141200000009,be
rezoned to Agriculture,as defined in the new Ordinance, based on the following findings of
fact:
1. The rezoning to Agriculture is consistent with the City's Comprehensive Plan and Future
Land Use Map,which designates this property for agricultural use.
2. The parcel is bordered on the north by property zoned Recreational and on south it is
bordered by property zoned Forest Management.
3. The parcel is bordered on the east by a property the City has proposed to be rezoned
Agriculture; the owner of this property has opted out of the City-wide rezoning and will have
a hearing in the future.
4. The parcel is bordered on the west by a property the City has proposed to be rezoned
Transition Residential; Pfeifer is also the owner of this property is requesting that this
property be rezoned to Agriculture.
5. The Agriculture zone is compatible with the Transition Residential, Forest Management, and
Recreational zones.
6. The property was zoned Agricultural under the previous ordinance, which had a minimum lot
area of 20 acres and a minimum lot width of 500 feet. Rezoning to Agriculture would not
change the minimum lot area or width.
7. The parcel area of 43 acres meets the minimum lot area of 20 acres for the Agriculture zone.
8. The parcel lot width of over 1,350 feet meets the minimum lot width of 500 feet for the
Agriculture zone.
3. Rezoning from Agriculture to Transition Residential,PIN 290142100A0009,Mary Pfeiffer,
City of Pequot Lakes.
The property is located east of downtown on County Road 11 and is roughly 12.5 acres in size.
The property was previously zoned Agricultural and the proposed zoning for the property is
Transition Residential. The owner has indicated to Staff that she would like to have the property
remain Agriculture to protect the property's natural features by limiting the density.
14084 Baxter Drive, Suite 7
Baxter, MN 56401
(218) 828-3064
www.communitygrowth.com
