Rezoning from Rural Residential to Transition Residential,PIN 290142300N00009,Joe <br /> Kimbler,City of Pequot Lakes. <br /> The property is located just to the south of downtown on Gravdahl Drive and is <br /> approximately 21,000 square feet in size. The property was previously zoned Rural <br /> Residential and the proposed zoning for the property is Transition Residential. The owner <br /> would like to have the property zoned Downtown Mixed Use. The property owner has <br /> indicated to Staff that the reason for the request is to have a smaller rear setback so that the <br /> existing house and a potential future deck would not encroach on the setback. In addition, <br /> this property already has sanitary sewer and water services. <br /> The Planning Commission is recommending that the property be rezoned to Downtown <br /> Mixed Use based on the following fmdings of fact: <br /> 1. The rezoning to Transition Residential is consistent with the City's Comprehensive Plan <br /> and Future Land Use Map. <br /> 2. The parcel is bordered on the east by property zoned Transition Residential. <br /> 3. The parcel is bordered on the west by a property that the City has proposed to be rezoned <br /> Transition Residential; the owner of that property, Motyka, however, is requesting that <br /> her property be rezoned to Downtown Mixed Use. This parcel is identical to the Kimbler <br /> property- <br /> 4. The property is bordered on the north and west by properties that are zoned Downtown <br /> Mixed Use. <br /> 5. Rezoning the property to Transition Residential or Downtown Mixed Use would not <br /> constitute spot zoning. <br /> 6. The Transition Residential and Downtown Mixed Use zones are compatible with each <br /> other. <br /> 7. The property in question is currently served by City sewer and water, a requirement for <br /> inclusion in the Downtown Mixed Use zone. <br /> 8. The property's size of roughly 21,000 square feet does not meet the minimum lot area of <br /> 5 acres for the Transition Residential zone. <br /> 9. The property's area of roughly 21,000 square feet meets the minimum lot area of 2,250 <br /> square feet for the Downtown Mixed Use zone. <br /> 10.
