City Council Minutes <br /> September 6, 2005 <br /> Page 5of12 <br /> -------------------------- <br /> FINDINGS OF FACT RECOMMENDED BY THE PLANNING <br /> COMMISSION AND CONTINGENT ON THE FOLLOWING CONDITION: <br /> 1. THAT LOTS 2 AND 3 OF BLOCK ONE SHALL BE RESTRICTED <br /> FROM ACCESSING COUNTY ROAD 17. <br /> COUNCIL MEMBER GREER SECONDED THE MOTION. MOTION <br /> CARRIED 7-0. <br /> 2. Preliminary Plat of Island Vista, Earl Hemmerich <br /> Dawn Bittner presented the staff report. Earl Hemmerich is requesting a <br /> preliminary plat to create seven residential lots from an 8.8 acre parcel. <br /> The Planning Commission recommended approval of the plat based on 14 <br /> findings of fact and three conditions. <br /> COUNCIL MEMBER GREER MOVED TO APPROVE THE <br /> PRELIMINARY PLAT OF ISLAND VISTA BASED ON THE 14 FINDINGS <br /> OF FACT RECOMMENDED BY THE PLANNING COMMISSION AND <br /> CONTINGENT ON THE FOLLOWING CONDITIONS: <br /> 1. THE ADDITIONAL 33 FEET OF RIGHT-OF-WAY TO THE WEST <br /> SHALL BE ACQUIRED FROM THE STATE OF MINNESOTA. <br /> 2. THE EXISTING OUTHOUSE ON LOT 3 AND THE EXISTING <br /> CABIN ON LOT 4 SHALL BE REMOVED. IN ADDITION, THE <br /> EXISTING DRIVEWAY SHALL BE ABANDONED. <br /> 3. THE EXISTING GARAGE ON LOT 4 SHALL BE REMOVED <br /> WITHIN SIX MONTHS OF APPROVAL OF THE FINAL PLAT IF A <br /> LAND USE PERMIT FOR A PRINCIPLE STRUCTURE HAS NOT <br /> BEEN OBTAINED. <br /> COUNCIL MEMBER SJOBLAD SECONDED THE MOTION. MOTION <br /> CARRIED 7-0. <br /> 3. Rezonings <br /> Dawn Bittner reviewed the rezoning requests. <br />
