Sandy Peine
From: Paul Sandelin [psandelin @lakesarealaw.com]
Sent: Tuesday, August 16, 2005 8:54 AM
To: Sandy Peine
Cc: Charles Marohn
Subject: pine vista plat
Sandy: just to confirm our conversation yesterday, as long as the applicant meets the requirements of the
ordinance for the subdivision the city would not have a basis to deny approval of the preliminary plat. The city can
certainly place conditions upon improvement of the road within the plat(built to city specs and blacktop). My
understanding is that the public road that provides access to the pine vista plat is a platted road that is maintained
by the City. It sounds as though the condition of this road is less than desirable. The option for the City is to
decide what method it will use to improve this section of road, i.e. through an assessment or a bond or some
combination of the two. I would recommend that the city consider adopting a master road plan and road
standards with a policy outlining how the road improvements will be paid. I am assuming that there may be future
plats that have this same issue that the City will need to confront. If you need anything further let me know.
Thank you.
Paul Sandelin
SANDELIN LAW OFFICE
30849 First Street P.O.
