1. A quiet title has been completed for Brunes Road and there is now guaranteed access <br /> to the property. <br /> 2. The rezoning was approved by the Planning Commission at this meeting. <br /> 3. The final plat agrees with the preliminary plat in lot configuration. The cul-de-sac <br /> included on the approved preliminary plat has been amended to be a rectangular <br /> shape. This change was presented,discussed, and approved at the April Planning <br /> Commission meeting. <br /> 4. The applicant has submitted a title opinion. <br /> 5. The applicant has not submitted a final plat check- <br /> 6. There is no need to post financial security for this subdivision. <br /> The Commission further recommends that the following conditions be included in a <br /> motion to approve: <br /> 1. The applicant shall submit a plat check within 60 days. <br /> 2. The applicant shall file a deed restriction indicating that the pole building shall be <br /> removed when Oak Street is improved,to be reviewed by the City attorney. <br /> 3. The roadway between the end of the existing road surface and the hammer-head shall <br /> be constructed with a Class 5 base prior to the City signing the plat,or security for <br /> such shall be provided <br /> 3. Application for Road Easement from Minuesota Department of Natural Resources, <br /> Earl Hemmerich. <br /> Earl and Jeannine Hemmerich own a property located on the western shore of Sibley Lake on <br /> North Sluetter Road The Hemmerichs would like to subdivide their property but need to <br /> have frontage on a public right-of-way for those lots. The Hemmerichs have proposed <br /> extending North Sluetter Road north in order to meet this requirement. However,North <br /> Sluetter Road runs along the border between Pequot Lakes and Loon Lake Township,putting <br /> half of the right-of-way in the City and the other half in the Township. <br /> The property immediately to the west of the Hemmerich property is State of Minnesota Trust <br /> Fund land managed by the Minnesota Department of Natural Resources. The Department of <br /> Natural Resources may grant permanent or temporary easements across State-managed land <br /> for the road,but because this is Trust Fund land, the easement can only be granted to a <br /> governmental unit and not an individual. <br /> Mr. Hemmerich is requesting that the City be named as the applicant to acquire the easement. <br /> Mr.Hemmerich will agree to pay the fees associated with the Application,and if the <br /> application is approved,the Hemmerichs will be responsible for the construction of the <br /> roadway.
