AGENDA ITEM #11 .3 <br /> REPORT TO <br /> CITY COUNCIL <br /> Date: August 5, 2005 <br /> Subject: Liquor Ordinance <br /> Report: Attached is a red-lined copy of a draft revision of <br /> the City's existing liquor ordinance. <br /> The ordinance needed to be revised to comply with State <br /> law. One other reason that this ordinance is being reviewed <br /> has to do with the number of on-sale licenses available. Our <br /> current ordinance allows 4 on-sale liquor licenses which <br /> was consistent with state law. However, the state law was <br /> amended to allow 4 on-sale licenses for a city our size, but <br /> the law does not include restaurants holding on-sale <br /> licenses to be included in this number. The City currently <br /> has five on-sale liquor establishments, all of them <br /> restaurants. <br /> As for the number of off-sale licenses, the state law leaves <br /> that decision to the City. Our current ordinance allows two <br /> off-sale licenses. There is currently one off-sale license. <br /> The Council must decide if two is sufficient. <br />
