AGENDA ITEM #11 .3
REPORT TO
CITY COUNCIL
Date: August 5, 2005
Subject: Liquor Ordinance
Report: Attached is a red-lined copy of a draft revision of
the City's existing liquor ordinance.
The ordinance needed to be revised to comply with State
law. One other reason that this ordinance is being reviewed
has to do with the number of on-sale licenses available. Our
current ordinance allows 4 on-sale liquor licenses which
was consistent with state law. However, the state law was
amended to allow 4 on-sale licenses for a city our size, but
the law does not include restaurants holding on-sale
licenses to be included in this number. The City currently
has five on-sale liquor establishments, all of them
restaurants.
As for the number of off-sale licenses, the state law leaves
that decision to the City. Our current ordinance allows two
off-sale licenses. There is currently one off-sale license.
The Council must decide if two is sufficient.
