CITY OF PEQUOT LAKES <br /> RESOLUTION 06-XX <br /> A RESOLUTION VACATING AN UNNAMED ALLEY/STREET <br /> BLOCK 2, COLE'S PLAT OF PEQUOT <br /> WHEREAS,the City Council of the City of Pequot Lakes has determined to vacate the <br /> unnamed alley/street legally described as follows (the "Subject Property"or"Alley/Street"): <br /> Unnamed Alley/Street in Block 2, Cole's Plat of Pequot lying between East Sibley <br /> Street and Oriole Street, according to the plat thereof, Crow Wing County; <br /> and <br /> WHEREAS, a public hearing was held on December 4, 2006 before the City Council in the City <br /> Hall after due published and posted notice had been given by the City Clerk on November 22, <br /> 2006, including mailed notice to all property owners within Cole's Plat of Pequot, and all <br /> interested persons were given an opportunity to be heard at the City Council Meeting; and <br /> WHEREAS,the City reserves any existing easements over,under, and across the Subject <br /> Property and in addition the City specifically grants and/or reserves an easement for drainage and <br /> utility purposes over,under, and across the Subject Property; and <br /> WHEREAS, it appears that it will be in the best interest of the City to vacate said Alley/Street; <br /> and <br /> WHEREAS,the Alley/Street is useless for the purpose for which it was laid out in the plat; and <br /> WHEREAS, four-fifths of all members of the City Council voted in favor of this Resolution; <br /> NOW,THEREFORE,BE IT RESOLVED,that pursuant to Minn. Stat. Sections 412.851 and <br /> 505.14: <br /> 1. The Alley/Street legally described as follows is hereby vacated: <br /> 1 <br />
