City Council Meeting <br /> January 11, 2006 <br /> Page 5 <br /> --------------------------- <br /> Attorney Sandelin suggested that the Council consider the issue that a hot <br /> mix asphalt operation is not addressed in the City's ordinance. <br /> Council Member Nagel indicated that he is grateful for the product that <br /> Anderson Brothers supplies. He further complimented their ethical <br /> standards. <br /> Council Member Nagel referred to the following sections of the City's <br /> Comprehensive Plan: <br /> Page 16. "Ensure that all new development complements and does not <br /> detract from the natural, scenic, and cultural amenities unique to Pequot <br /> Lakes." <br /> Page 39. "Much of the tourism in Pequot Lakes can be attributed to the <br /> Paul Bunyan State Trail. The City needs to recognize the primary reason <br /> why people are moving to the area and the importance of the environment <br /> as an economic development engine. As such, the City must work to <br /> protect the local environment as a long-term economic development <br /> strategy. It must take a balanced approach to ensure that long-term <br /> environmental quality and beauty are not sacrificed for short-term gain." <br /> COUNCIL MEMBER SJOBLAD MOVED TO DENY THE CONDITIONAL <br /> USE PERMIT APPLICATION FOR AN EXTRACTIVE USE BY <br /> ANDERSON BROTHERS BASED ON THE FINDINGS OF FACT <br /> PRESENTED BY THE PLANNING COMMISSION ON NOVEMBER 17, <br /> 2005, AS FOLLOWS: <br /> 1. The use or development does not conform to the <br /> comprehensive land use plan. <br /> 2. The use is not compatible with the existing neighborhood. <br /> 3. The use with conditions would be injurious to the public <br /> health, safety, welfare, decency, order, comfort, convenience, <br /> appearance or prosperity of the City. <br /> 4. The conditional use will impede the normal and orderly <br /> development and improvement of surrounding vacant property for <br /> uses predominant in the area. <br /> 5. Adequate measures cannot be taken to prevent or control <br /> offensive odor, fumes, dust, noise, and vibration, so none of these <br /> will constitute a nuisance and to control lights and signs in such a <br /> manner, that no disturbance to neighboring properties will result. <br /> 6. The conditional use will not promote the prevention and <br /> control of pollution of the ground and surface waters including <br /> sedimentation and control of nutrients. <br />
