The City would like to try to negotiate the purchase of the
land from the property owner. The City Attorney has
recommended that if this is not possible, then the City
could acquire the property through condemnation.
CITY'S OPTIONS
The three options available to the City are listed below:
1) Negotiate the purchase of the land with the property
owners.
2) Improve the road as it is (no widening, ditching, etc.)
(The City does not see this as a reasonable option).
3) Acquire the property through condemnation. The City
would incur legal costs on top of paying for the
property.
Council Action Requested: 'It is the City Attorney's
recommendation to offer the appraised value of the
property to the property owners. If the Council concurs
with this, they could make a motion to negotiate an offer of
the appraised value of the property.
We prefer to not make the appraised value, or the
amount of money the City will be offering, public at the
Council meeting.
The money for this transaction is in the 2005 budget under
capital outlay in the Street budget.
