The City would like to try to negotiate the purchase of the <br /> land from the property owner. The City Attorney has <br /> recommended that if this is not possible, then the City <br /> could acquire the property through condemnation. <br /> CITY'S OPTIONS <br /> The three options available to the City are listed below: <br /> 1) Negotiate the purchase of the land with the property <br /> owners. <br /> 2) Improve the road as it is (no widening, ditching, etc.) <br /> (The City does not see this as a reasonable option). <br /> 3) Acquire the property through condemnation. The City <br /> would incur legal costs on top of paying for the <br /> property. <br /> Council Action Requested: 'It is the City Attorney's <br /> recommendation to offer the appraised value of the <br /> property to the property owners. If the Council concurs <br /> with this, they could make a motion to negotiate an offer of <br /> the appraised value of the property. <br /> We prefer to not make the appraised value, or the <br /> amount of money the City will be offering, public at the <br /> Council meeting. <br /> The money for this transaction is in the 2005 budget under <br /> capital outlay in the Street budget. <br />
