COVENANTS: <br /> It is further agreed between the Lessor and Lessee that this Lease is made upon the <br /> condition that if the Lessee shall neglect or fail to keep, observe and perform any of the <br /> covenants and agreements contained in this Lease,which are to be kept, observed or performed <br /> by the Lessee, or if the leasehold interest of the Lessee shall be taken on execution or other <br /> process of law,or if the Lessee shall petition to be or be declared bankrupt or insolvent according <br /> to law,or if the Lessee shall vacate said premises or abandon the same during the term of this <br /> Lease,than and in any of said cases Lessor may immediately or at any time thereafter, and <br /> without further notice or demand, enter into and upon said premises, or any part thereof,in the <br /> name of the law and take absolute possession of the same fully and absolutely without such re- <br /> entry working for a forfeiture of the rents to be paid and the covenants to be performed by the <br /> Lessee for the full term of this Lease. This Lease shall not be assigned or sublet without the <br /> written permission of the Lessor. It is further agreed that if the premises are damaged or <br /> destroyed,to such an extent that the parties agree that the premises are uninhabitable, Lessor <br /> shall be under no obligation to repair the premise, and this Lease shall terminate,unless <br /> otherwise agreed upon by the parties. <br /> 9. TAXES: <br /> Lessor shall pay all real estates taxes on said premises. <br /> 10. DEFAULT: <br /> If default should be made in any of the covenants of this Lease, Lessor or his or her legal <br /> representatives may, immediately or at any time thereafter,take possession of said property, <br /> wherever it may be found, forcibly, if necessary, without being deemed guilty of any manner of <br /> trespass, and without thereby rendering itself liable to refund any sums received as rent as <br /> aforesaid, and thereupon this Lease shall terminate,but without prejudice to any remedies which <br /> Lessor might otherwise use for arrears of rent or any breach of the covenants of the Lessee <br /> contained in this Lease. <br /> 11. LATE CHARGES/NSF CHECKS: <br /> For each payment that is not paid within 5 days after its due date, Lessee shall pay a late <br /> fee equal to 5%of the required payment. Payment will be deemed made when it is received by <br /> Lessor, or when it is mailed by Lessee, evidenced by the postmark on the envelope in which the <br /> payment is mailed. Lessee shall be charged$20.00 for each check that is return to Lessor for <br /> lack of sufficient funds. <br /> 12. ACCESS BY LESSOR: <br /> Lessor shall have the right to enter the property to make inspections during regular <br /> business hours. Lessor does not assume any liability for the care or supervision of the property. <br /> In the case of emergency, Lessor may enter the property without Lessee's consent. IF Lessee <br /> elects not to exercise the options to continue to occupy the property, Lessor shall be allowed to <br /> display"For Rent" signs in places to be agreed upon by Lessor and Lessee, and to show the <br /> property to prospective tenants. <br />
