City of Pequot Lakes <br /> June 6, 2006 <br /> Page 2 <br /> bringing the property condition into compliance in the immediate future. Although I <br /> wholeheartedly supported this decision, I regretfully object to the individual selected to act as <br /> liaison. It is my understanding that the particular appointed Planning Commission member owns <br /> adjacent property and, therefore, has a personal interest creating a conflict of interest in acting in <br /> this capacity. I request the City Council suggest that the Planning Commission revisit this issue <br /> and consider appointing a different member of the Planning Commission to act as a liaison. <br /> The second issue involves the City's administrative rezoning of the property. The City has acted <br /> to administratively rezone the property for the exclusive purpose of making the new zoning <br /> classification of the property consistent with the current zoning ordinance. It is my <br /> understanding that the allowed uses and other zoning requirements would not be affected as a <br /> result of this administrative rezoning. <br /> Ms. Watt has advised the City that she intends to request the property be rezoned for commercial <br /> use. Unfortunately, she has been physically unable to pursue this rezoning as a result of both <br /> health problems and her inability to process a rezone application while the above described <br /> zoning issues regarding the condition of the property are not finally resolved. (I have enclosed <br /> medical records reflecting Ms. Watt's recent hospitalization and incapacitation). <br /> On behalf of Mrs. Watt, this office requests the City to postpone the current administrative <br /> rezoning issue so it can be addressed at the same time as Ms. Watt's application to rezone her <br /> property. There is no need, much less urgency, for the administrative rezoning and the <br /> duplicative process is wholly unnecessary. The appropriate zoning classification for the property <br /> will be addressed pursuant to Ms. Watt's application in the immediate future, and the pending <br /> administrative rezoning is potentially prejudicial to Ms. Watt's rights in those proceedings. <br /> Therefore,we urge the City Council to continue the rezoning matter to a later date. <br /> We expect to be present at the City Council meeting to address questions, although Ms. Watt's <br /> physical condition may prevent her from being able to attend.
