Chapter 169.022 which the Attorney General includes in his analysis clearly preempts the <br /> field of enforcement as well as long standing case law of State v Hoben, 256 Minn 436, <br /> 98 N.W. 813 (1959). Minn Statutes 169.91 and 169.99 specify the procedures to be <br /> followed by peace officers in connection with arrest of traffic violators, and the uniform <br /> form of traffic ticket, having the effect of a summons and complaint, which must be used <br /> by all peace officers. Consequently, while cities are granted specific authority to exercise <br /> certain regulatory control of streets and roads within their boundaries, they are plainly <br /> precluded from creating their own enforcement systems inconsistent with those <br /> prescribed by statute. <br /> We are a nation of laws. Our local units of government need to comply with the law just <br /> as citizens are expected to comply with the law. If cities can not live within the rule of <br /> law why should citizens?
