Administrative Fines/City Ordinances
I am recommending that the City of Pequot Lakes implement Administrative Fines that
will involve numerous statutes that we currently use for State Tickets.
Basically what this program does is allow the city to govern themselves more than they
are now when it comes to violations involving petty misdemeanors only. These are
tickets that if presented in the State/County system would NOT be subject to jail time.
There are numerous cities around that state that use this method and it works very well.
Little Falls, Pine River, Long Prairie,New Ulm, Redwood Falls, Staples to name a few.
In a nut shell, what happens is we issue the person a City of Pequot Lakes Administrative
Ticket. They have 14 days to mail in the ticket/fine money. If they choose not to do that,
we mail them a friendly reminder. After 60 days if we have not received their ticket/fine
money, we then issue them a state/county ticket for the offense. This is a very simple
procedure and there are no Double Jeopardy issues.None of these Admin Fines will
appear on their driving record or be reported to their insurance company.
Violations that would be under the Administrative Fines would be as follows:
Speeding
Stop Sign
Passing violation
Exhibition driving
Public Nuisance
Trespassing
Seatbelt violations/adult and children
Disorderly Conduct/school disorderly conduct
Public intoxication
The other ones we already have in place such as parking, animal ordinances, planning
and zoning etc will stay in place.
