COMMUNITYGROWTH <br /> N S T 1 T U T E <br /> February 20, 2006 <br /> Mayor and City Council <br /> City of Pequot Lakes <br /> 4638 County Road 11 <br /> Pequot Lakes, MN 56472 <br /> Re: Zoning Administrator's Report <br /> Dear Mayor and City Council, <br /> The Planning Commission met for their regularly scheduled February meeting where they held three <br /> public hearings — one for a preliminary plat, one for a final plat, and one for an individual property <br /> rezoning. Both the preliminary and the final plats were tabled with requests for more information. The <br /> Planning Commission is forwarding the following recommendations for your consideration: <br /> 1. Rezoning from Rural Residential to Transition Residential, City of Pequot Lakes — Parcel IDs <br /> 290114400CA0009, 290114400CB0009, and 290114400CC0009, Michael and Kelly McBrien, <br /> owners. <br /> The McBrien properties are located along County Highway 11 just to the east of Downtown. <br /> Properties "CA"and"CB"are both roughly 30,000 square feet in size, while property "CC"is about <br /> `-' 20,000 square feet. The properties were previously zoned Rural Residential under the old Ordinance, <br /> and the proposed zoning for the properties is Transition Residential. Mr. McBrien has indicated that <br /> he would like to have his properties,particularly along the roadway,be rezoned to Commercial. <br /> The Planning Commission is recommending that the properties with Parcel IDs <br /> 290114400CA0009, 290114400CB0009, and 29011440OCC0009 be rezoned to Rural Residential <br /> (new Ordinance classification)based on the following findings of fact: <br /> 1. The rezoning to Transition Residential is consistent with the City's Comprehensive Plan and <br /> Future Land Use Map,which designates this area as an urban/rural transition area. <br /> 2. The rezoning to Commercial does not conform to the City's Comprehensive Plan or Future Land <br /> Use Map. <br /> 3. The subject properties are surrounded by a parcel that the City has proposed to rezone to <br /> Transition Residential. This property,and the property immediately adjacent to the east have both <br /> opted out of the blanket rezoning and have yet to have their rezoning public hearings. <br /> 4. The parcel is bordered to the south by a property that the City has proposed to rezone to <br /> Agriculture from Forestry. This property has also opted out of the blanket rezoning and has not <br /> yet been rezoned. <br /> 5. The Transition Residential Zone is compatible with the Rural Residential, Agriculture, and <br /> Recreation zones; however, the Land Use Ordinance indicates that the Transition Residential <br /> zone can be established next to these zones so long as these zones do not surround the Transition <br /> Residential zone.
