Subdivision 2 - Other Lan Ts=. Other land uses not listed in the foregoing table shall <br /> be classified by the Roads& Streets Department assigning them to classes most nearly like the <br /> uses, from the standpoint of run off volume for the standard rainfall event. An appeal of such <br /> classification from the determination of the Roads& Streets Department may be made to the <br /> City Council within sixty(60)days following the mailing of the classification to the owner. <br /> Subdivision 3 -Adjustments. The City Council may. resolution adopt policies <br /> providing for the adjustment of charges for parcels based upon land use data supplied by affected <br /> property owners which demonstrates a run off volume for a standard rainfall event substantially <br /> different from the REF being used for such parcels(such adjustment for storm water drainage <br /> fees shall not be made retroactively). A credit of up to 50%of the Storm Water Drainage fee <br /> may be given if the property owner has or develops on-site retention of the storm water. <br /> Subdivision 4-ExgmptiQn. Public street right-of-way is exempt from storm water <br /> drainage charges. <br /> SECTION 3 -Payment of Fees <br /> Subdivisi n 1 -Fees. Statements for storm water drainage fees shall be made a part of <br /> the present utility billing system invoiced through the City Clerk's Office for the City of Pequot <br /> Lakes on a quarterly basis. <br /> Subdivision 2 -Recalculation of Fee. If a property owner or person responsible for <br /> paying the storm water drainage fee questions the accuracy of an invoice, such person may have <br /> the determination of the charge recalculated by written request to the City Council within sixty <br /> (60) days following the mailing of the invoice by the City. <br /> Subdivision 3 - City to establish Rill Sygern.. The user charges provided for in this <br /> article shall be collected by the City through a period billing and collection procedure, to be <br /> established in regular form by the City, and such procedure shall be effective upon approval of <br /> the Council by resolution. Such procedures shall include a late penalty provision and shall <br /> provide for an interest charge on the unpaid balance of such charges. Each billing for storm <br /> water drainage fees which are not paid when due shall incur a penalty charge of 1.5%per month <br /> or 18%per annum of the amount past due. <br /> Subdivision 4 -Joint T lability for Pay =. The owner of premises which are connected <br /> to the City's waste water facilities,the occupant thereof, and the use of service shall be jointly <br /> and severally liable to pay for the service on such premises. The service is furnished to the <br /> premises by the City only upon the condition that the owner of the premises, occupant and use of <br /> the services, axe jointly and severally liable to the City therefore. <br />
