buildings, fences and other improvements on said farm unless specifically <br /> agreed otherwise herein. <br /> (d) The Tenant is also to destroy all Russian Thistles and other noxious weeds <br /> growing on said land, declared by statute to be common nuisances, within <br /> the time prescribed by law, and shall keep all roadways and other parts of <br /> the land,not in crop, mowed and free from growing weeds. <br /> 6. Irrigation Schedule. The irrigation system shall not interfere with the harvesting <br /> of crops on said property. The discharge of effluence through the irrigation <br /> system shall be at such times when Tenant is not in the process of harvesting <br /> crops, these times of harvest to be at the option of Tenant, commencing with July <br /> 15, 2006. The Landlord will irrigate when requested by Tenant, as long as <br /> weather conditions permit,but the Landlord reserves the right to irrigate if <br /> necessary to maintain acceptable levels of effluent in the wastewater treatment <br /> system ponds. <br /> 7. Plant Operator. Landlord shall have in its employ a certified operator, and said <br /> certified operator will have competed the necessary training as required by the <br /> Minnesota Pollution Control Agency in the operation of the Wastewater <br /> Treatment Plant and the Center Pivot Irrigation System. <br /> 8. Costs. The Landlord shall bear all costs related to the operation of the Center <br /> Pivot Irrigation System, including but not limited to lubricants, electricity, and <br /> parts. <br /> 9. Insurance. The Landlord shall obtain and hold in effect an insurance policy <br /> covering damages and theft to the Center Pivot Irrigation System located on said <br /> premises. Tenant shall obtain and hold in effect an insurance policy covering all <br /> other liabilities in relation to said premises including but not limited to damages <br /> or bodily injury that may occur thereon. <br /> 10. Right of Entry. Landlord, as well as agents and employees of the Landlord, <br /> reserve the right to enter the premises at any reasonable time to: (a) consult with <br /> the Tenant; (b) irrigate; (c)make repairs, improvements, and inspections; none of <br /> which is to interfere with the Tenant in carrying out regular farm operations. <br /> 11. Binding on Heirs. The provisions of this Lease Agreement shall be binding upon <br /> the heirs, executors, administrators, and successors of both Landlord and Tenant <br /> in like manner as upon the original parties, except as provided by mutual written <br /> agreement. <br /> 12. No Right to Sublease. Landlord does not convey to Tenant the right to lease or <br /> sublet any part of the premises or to assign this lease to any person or persons <br /> whomsoever. <br />
